Ms Busisiwe Mkhwebane has written to President Ramaphosa, informing him of her intention to return to office tomorrow, 5 September, since she holds the (erroneous) view that the section 194 process is finalised.

The Courts have previously found that Ms Mkhwebane has a fundamentally flawed grasp of the law and the Constitution on a multitude of occasions, and this latest frolic, this demonstration of misplaced arrogance, merely underlines that she is simply not fit for purpose.

The section 194 process will be finalised by the vote in the National Assembly on 11 September, and not before. Ms Mkhwebane, and whomsoever is advising her, should know that.

Any return to office prior to those proceedings being concluded will be contra her notice of suspension and must attract embarrassing and undignified consequences.

Ms Mkhwebane will be well advised to reconsider. She is not doing her own cause any good, nor is she giving any thought to the consequences of her actions on the office she notionally heads.
