AS NOTIFIED OF A PDC (PROVINCIAL DISCIPLINARY COMMITTEE) PROCESS OF July 9, 2014 AS CONVEYED TO YOU BY EMAIL, YOUR ATTENTION IS BROUGHT TO THE CHARGE SHEET AS DRAWN BELOW. NOTICE DATED July 1, 2014, SENT TO [email protected] AND HAND DELIVERED TO YOU AND RECEIVED BY YOUR ATTORNEY ON JULY 2, 2014.

CHARGE SHEET

IN RESPECT OF A DISCIPLINARY PROCESS IN TERMS OF ARTICLE TWENTY THREE OF THE CONGRESS OF THE PEOPLES CONSTITUTION, A DC (DISCIPLINARY COMMITTEE) HAS BEEN CONSTITUTED WITH THE ENDORSEMENT OF THE CNC ( CONGRESS NATIONAL COMMITTEE) TO HEAR YOUR SIDE OF THE STORY AND RECOMMEND TO THE CNC ( CONGRESS NATIONAL COMMITTEE) WHICH WILL MAKE A FINAL DECISION.  YOU ARE ALSO MADE AWARE THAT YOU HAVE AN OPTION TO APPEAL ANY SANCTION THAT MAY BE IMPOSED ON YOU, WHICH YOU HAVE TO DO IN FOURTEEN DAYS FROM THE HEARING.

ALLEGATIONS AGAINST YOU.

It is alleged that you are guilty of serious misconduct regarding the breach of a COPE Code of Conduct for Councillors who are Public Representatives after the 2011 local government elections. Your actions have further caused a strain in the coalition arrangement between COPE and the DA in the municipality of Bitou, where we co-govern with the DA, your action has brought the party into disrepute.

CHARGE: 1

Breach of party agreement and decisions:

It is alleged that you connived with the ANC in council by endorsing  (in the form of appending your signature in a letter dated 20 June 2014 which called for a council meeting scheduled for July 1, 2014)  a request by ANC councillors to pass a vote of no confidence to the,

1. Speaker

2.  Executive Deputy Mayor and (yourself)

3. Executive Mayor

In-subordination AND CONTEMPT TO PARTY STRUCTURES:

You deliberately absented yourself from a POB ( Provincial Office Bearers) meeting that you were notified to attend on Wednesday June 24,2014 in Parow COPE offices, upon your request the meeting was arranged for Monday 22 June,2014, at 5:30. POB members waited until 6pm and you did not show up nor was these an excuse.  This is an act of in-subornation to a body that you are accountable to as a public representative.

NB:

 YOUR, RELATIONSHIP AND TRUST HAS BEEN IRRETRIEVABLE BROKEN WITH THE STRUCTURES OF THE PARTY.

NB:

PLEASE   be advised that:

(a)    You have the right to be represented at the hearing by a member of COPE who is a paid up member.

(b)   You or your representative may lead evidence, you may call witnesses you may cross-examine witnesses.

(c)    Your absence at the hearing without a valid reason being received two days prior to the start of the proceedings and in such an event a hearing will continue in your absence.

(d)   The Congress of the People reserves the right to amend or to supplement this charge sheet should this prove to be necessary. You will be notified in writing of the same.
