Mangosuthu Buthelezi takes legal action against COGTA

Arrangements for Traditional Council Elections on February 19 failed to comply with requirements

PRINCE BUTHELEZI TAKES LEGAL ACTION AGAINST COGTA

Prince Mangosuthu Buthelezi MP, in his personal capacity and on behalf of the Buthelezi Traditional Council, launched legal action on Monday, 06 February 2012 against the Department of Co-Operative Governance and Traditional Affairs (Cogta) and its MEC, Ms Nomusa Dube.

It is Prince Buthelezi's view that Cogta and MEC Dube, in the process of finalizing the arrangements to hold Traditional Council Elections on 19 February 2012, failed to comply with the requirements of the KwaZulu Traditional Leadership Regulations, 2006, and Chapter 2 of the Electoral Act 73 of 1998, in preparing the voters' roll for this election.

Prince Buthelezi is asking the Court to declare this process irregular and unlawful. In addition, the application seeks to interdict and restrain Cogta and the MEC from:

(a) holding the KwaZulu Natal Traditional Council Elections on 19 February 2012; and 

(b) holding the KwaZulu Natal Traditional Council Elections on any other date, until the procedural requirements for the compilation of the voters' roll, as set forth in the Regulations and the Electoral Act, have been complied with.

The urgent court application will be heard on 15 February 2012.
