Union says Judge Mandla Mbongwe's ruling was a vindication, its rival just wasted metalworkers hard earned monies

LIMUSA welcomes the sober Gauteng High Court ruling on NUMSA urgent application

The Liberated Metalworkers Union of South Africa (LIMUSA) warmly welcomes the outcomes of the Gauteng High Court to dismiss the urgent application by NUMSA with costs.

As LIMUSA, we were caught by surprise on Friday 05 June 2015 when we received urgent court papers from NUMSA.

Apparently NUMSA filed an urgent court application the on 03rd June 2015; which was seeking the following declarations to be made the Gauteng High court:

I. NUMSA is and remains an affiliate of COSATU.

II. NUMSA full contingent of delegates to attend COSATU Special National Congress on the 13 and 14 July 2015.

III. The Special National Congress has all the powers of any National Congress.

IV. LIMUSA is precluded from participating in COSATU Special National Congress of the13 and 14 July 2015

As LIMUSA, we filled our opposing affidavit with reference that as an affiliate of COSATU we are guaranteed full rights to participate in all meetings and activities of the federation, thus includes the Special National Congress which is scheduled for 13-14 July 1015.

On the 09 June 2015, Judge Mandla Mbongwe after hearing arguments from parties he decided to dismiss NUMSA urgent application with costs because there was no legal nor logical bases on their arguments.

The judge shouldn’t comprehend with the fact that NUMSA knew about a November 2014 COSATU CEC decision to hold a Special National Congress in 13 – 14 July 2015 but only decided to file an urgent application on 03 June2015.

We are vindicated by this judgment that it was nothing but a mere publicity stunt and a gross misappropriation of metalworkers hard earned monies by the ‘headline seekers of the moment’.

Their well-orchestrated attempts to capture COSATU to their newly found political home, the United Front or Movement for Socialism, has dismally failed. 

We remain unshaken and convinced that no amount of court applications, financial resources and rhetoric will deter us from defending COSATU’s constitution, founding principles and maximum unity. 

It is only through LIMUSA that metalworkers shall remain fully represented and partake in all affairs of COSATU.

We calling on all metalworkers to set aside all their prejudice against each other and strive for maximum unity by joining LIMUSA.
