The DA has noted claims by former boss of Crime Intelligence, Mulangi Mphego, that the so-called "spy tapes" are not the work of Crime Intelligence (see Sunday Independent report).

This calls into question whether the tapes, used by former National Director of Public Prosecutions, Mokotedi Mpshe, as reason to drop over 700 charges of fraud and corruption against President Zuma, are genuine articles. It also calls into question where the tapes originate from, and who was responsible for their recording. 

The DA has long held that the decision to drop the charges against Zuma must have been rational, on the basis of sound evidence; or the decision must be set aside.

If the tapes are not genuine, or did not emanate from the correct spy agencies, they would be inadmissible in support of Mpshe's decision on the Zuma charges.

This latest claim adds weight to the DA's case to expose the spy tapes.

The DA has already obtained an order from the Gauteng North High Court to compel the National Prosecuting Authority to hand over the tapes. On 15 August 2014 the DA will return to the Supreme Court of Appeal in order to enforce the delivery of the tapes.

The DA also notes that in this Supreme Court of Appeal case, President Zuma has cited that the DA could use the content of the spy tapes "to his detriment." This further enforces our position that the tapes must be revealed and that the truth behind the dropping of charges against Zuma must be made known.
