To: The Hon Chief Justice
The Hon Judges of the Constitutional Court
RE: JOINT STATEMENT BY JUSTICES NKABINDE AND JAFTA
I have received a joint statement by Justices Nkabinde and Jafta which they say they intend no complaint nor any statement.
The Judges of the Court have gone on record as having lodged a complaint and the Commission has a written complaint by them in its possession.
As you know, the Commission cannot deal with a complaint unless there is evidential material to support it. May I ask the other Commissioners please be advised:
(a.) is a complaint to be pursued?
(b.) If so, what is the evidence to support it?
(c.) If not, the Commission, Judge President Hlophe and the public need to be so informed.
Yours sincerely
SIGNED
JUSTICE CT HOWIE
