ANC Western Cape leader Marius Fransman repeats his call that government departments and other state institutions just implement the right policy and interpretation of affirmative action in its entirety.

This follows on the Constitutional Court judgement against DCS’s erroneous application of the legal guidelines for people of colour.

"I have since 2013 consistently cautioned that employment equity is not to define black as African people only. The ANC’s position is that affirmative action must support all those disadvantaged under apartheid, which is black people consisting of African, Coloured and Indian.

“The position was and is clear. Every official and business manager must be sensitive to such reality! We must continue to address the historical injustices of the past and to affirm our historically disadvantaged groups on the basis of race, gender and disability as we progressively realise this in the workplace. The letter and spirit of the legislation means Africans, Coloureds, Indians, women and those living with disability must all benefit from affirmative action.

"I repeatedly said national demographics cannot be used alone as regional demographics in a province like the Western Cape and Northern Cape must also be taken into consideration. There was no need for this expensive, long-drawn-out and awkward legal battle if state departments just implemented the policy and laws as given by the governing ANC," Fransman added.
