MEDIA RELEASE by Acting Judge Kgomotso Moroka and Cyril Ramaphosa
1. Today Acting Judge Kgomotso Moroka and Cyril Ramaphosa announced their decision to resign from the Freedom Under Law (Ful), an organisation headed by retired Judge Johann Kriegler following Judge Kriegler's announcement that the FuL would be challenging the decision of the Judicial Services Commission not to probe Cape Judge President John Hlophe (see report).
2. Acting Judge Moroka is a member of the Freedom Under Law Board of Directors and Cyril Ramaphosa is a member of the Freedom under Law International Advisory Board.
3. Advocate Moroka and Mr Ramaphosa both said: "We are deeply concerned that whilst we are members of the FuL's constituent governance structures we were not informed, let alone consulted about the FuL's decision to embark on this legal challenge. We are of the view that the decision to challenge the decision of the SC in the manner that the FuL intends to do is a major decision that requires that the views of the members of the FuL's constituent bodies be fully and thoroughly canvassed. This would be good governance. The failure to do so has put us in an embarrassing position and has compromised our ability to add value to the work of the FuL.
4. The failure to consult us has left us with no choice but to resign forthwith from the FuL.
