Ad hoc committee report on Public Protector's IEC report adopted - ANC

Office of Chief Whip says it was not possible to accede to certain recommendations as it would be unconstitutional to do so

ADOPTION OF THE AD HOC COMMITTEE REPORT ON PUBLIC PROTECTOR'S IEC REPORT

The African National Congress welcomes the adoption this afternoon, by the National Assembly, of the report of the Ad Hoc Committee established to consider and report on the recommendations contained in the Public Protector's Report 13 of 2013/4 regarding certain matters related to the procurement of office accommodation for the Electoral Commission.

The National Assembly accepted the report of the ad hoc committee in which it resolved that, after considering a legal opinion from Parliament's law advisors, it was unable to accede to certain of the recommendations or requests of the Public Protector addressed to the Speaker of the National Assembly on the grounds that to do so would be unlawful or unconstitutional.

The Assembly accepted the recommendation of the ad hoc committee that the Electoral Commission, National Treasury and the Auditor General, complete the actions which they are currently engaged in to implement those recommendations of the Public Protector that are legally permissible.

The ANC reiterates its respect and support for the Constitution of the Republic and the institutions created in terms of the Constitution, including the Public Protector and the Electoral Commission.

The ANC calls upon all South Africans to support the work of the Electoral Commission, particularly ahead of the crucial 2014 elections.
