Former DP may not hold himself out as president of the party

BEFORET THE HONOURABLE ACTING JUDGE WATT-PRINGLE

In the matter between:-

CONGRESS OF THE PEOPLE - Applicant

And

SHILOWA MBHAZIMA - Respondent

HAVING read the documents [unclear] considered the matter

IT IS ORDERED THAT:-

1. An interim interdict is issued against MBHAZIMA SHILOWA ("the respondent") in the following terms-

1.1 The Respondent is interdicted and restrained from holding himself out in any way and to any person or entity as a member, office bearer or representative of the Applicant, or as the President of the Applicant.

1.2 The Respondent is interdicted and restrained from holding himself out or in any way acting as a member nominated by the Applicant of the National Assembly.

1.3 The Respondent is interdicted and restrained against issuing or causing any instructions to be issued in any form to the Applicant's bankers, including the STANDARD BANK OF SOUTH AFRICA LIMITED, concerning any of the Applicant's bank accounts:

1.4 The Respondent is interdicted and restrained from taking any steps, directly or indirectly, that have the effect of debarring or preventing members and office bearers of the Applicant from gaining access to and carrying on the affairs and business of the Applicant at the Applicant's offices at 5th and 6yh Floors, Metropolitan Building, 108 Fox Street, Johannesburg, or at any other of the Applicant's offices.

2. The interim interdicts in paragraph 1 above will operate pending the final end and determination of an action to be instituted by the Applicant against the Respondent within a period of one (1) month from the date of this order.

3. The Respondent is to pay the costs of the application on the scale as between attorney and client

4. The Respondent is given leave to anticipate this order on not less than 24 hours to the Applicant.
