Gross misconduct against Judge Nkola Motata filed with Parliament

RECEIPT OF CORRESPONDENCE REGARDING JUDGE NJ MOTATA'S GROSS MISCONDUCT REFERRAL

Parliament, Friday, 25 August 2023 - The Office of the Speaker of the National Assembly confirms the receipt of a correspondence from the Chief Justice of the Republic of South Africa, Justice Raymond Zondo, pertaining to a finding of gross misconduct against Judge Nkola Motata. The letter, received on August 18, 2023, will be brought to the attention of Members of Parliament through the official parliamentary publication, "Announcements, Tablings, Committees Reports (ATC)."

In the letter, Chief Justice Zondo apprises the Speaker, Ms Nosiviwe Mapisa-Nqakula, of the Judicial Conduct Tribunal's determination that Judge Motata has been found guilty of gross misconduct in line with section 177(1)(a) of the Constitution. The Tribunal further recommended the invocation of section 177(1)(a) of the Constitution for potential removal.

The letter from Chief Justice Zondo will be referred to the Justice and Correctional Services Committee of the National Assembly, where it will be subject to consideration. The committee will assess the contents of the correspondence, including relevant supporting material, in order to formulate recommendations for the consideration of the National Assembly.
