Acting Hawks Head saddened by Judge Matojane's remarks

Pretoria - The Acting Head of the Directorate for Priority Crime Investigation (DPCI) Major General Mthandazo Ntlemeza has been deeply saddened by the comments made by North Gauteng High Court Judge Elias Matojane when delivering his judgement on Monday, 23 March 2015.

The presiding judge has commented that Major General Ntlemeza was biased, labelling him a liar, dishonest and that he lacked integrity and honour. The judge further accused Ntlemeza  of making false statements under oath; after Ntlemeza's revelations that Judge Matojane had met privately with Major General Sibiya's legal team to arrange a date in which the matter would be heard in court.

Major General Ntlemeza has opted not to comment on the Judge's remarks at this stage because he has decided to appeal against the Rule 49 (11) judgement  and to petition  the Supreme Court of Appeal (SCA) on the refusal of leave of appeal.

The remarks of the judge which falls within the reasons for judgement and for refusing leave to appeal and granting the Rule 49 (11) will be canvassed in the papers that will be filed with the SCA. Such remarks, which fall outside the scope of the judicial process will be referred to the appropriate forum such as the Judicial Service Commission for investigation once all the due process has been finalized and upon getting legal advice.
