NPA STATEMENT REGARDING PROGRESS IN THE INTAKA KZN CASE

The National Prosecuting Authority comments as follows regarding the process for the execution of warrants of arrest for KZN Economic Development and Tourism MEC, Mr Mike Mabuyakhulu and Speaker of Provincial Legislature Ms Peggy Nkonyeni.

The signing by the Acting DPP of KZN, Adv Simphiwe Mlotshwa of the two warrants of arrests on 4 July 2011 followed on-going internal discussions by the prosecuting team, the police and consultation with the Office of the National Director of Public Prosecutions (ONDPP), on the assessment of the evidence uncovered and the suspects involved.

A decision was made that arrests could be made on those against whom evidence was clearer. On the other individuals, an analysis of the evidence and discussion thereof would continue. The position in respect of the latter changed in that it was felt that the additional individuals should also be arrested and joined with Hon. Mr Mabuyakhulu and Hon. Nkonyeni.

After further consultations, the ONDPP requested the police to hold back the execution of the warrants in order to enable the prosecuting team to prepare the relevant charge sheet. This is currently being done and is expected to be finalised in the next couple of days.

As soon as that process is completed, the prosecuting team will brief the NDPP after which an appropriate statement will be issued. It should be noted that in law a warrant of arrest remains in force until it is executed or cancelled. These warrants remain legally enforceable and will be executed soon and there is no intention to cancel them at any stage.
