Council passes motion stating that it has consistently failed to meet its executive obligations in terms of the constitution over past two years

Oudtshoorn Municipal Council accepts Provincial intervention

Oudtshoorn, 28 July 2015 – The Oudtshoorn Municipal Council has today, 28 July 2015 at its special Council meeting accepted the Western Cape Provincial Government’s proposal to intervene in terms of section 139(1) of the Constitution.

The motion which was raised by Cllr Julia le Roux Krowitz states that the “Council has over the past two years consistently failed to meet its executive obligations in terms of the constitution”.

“The Council agrees with MEC Anton Bredell’s proposal dated 14 July recommending and supporting that the Provincial Executive intervenes in the Municipality by taking appropriate steps to ensure that the dysfunctionality of the Municipal Council is remedied and it is assisted in fulfilling its executive obligations,” Krowitz said.

The Council will during the period of the intervention by the Provincial Executive regularly review the ambit and need for continued intervention and make any appropriate recommendations to the Provincial Executive in this regard.

“Council reiterates, as part of its comments in respect of the letter from Minster Bredell that it has agreed to and also supports the implementation of the “Support Package” offered by the National Minister of COGTA, Minsiter Pravin Gordhan and the Provincial Minister Bredell in terms of section 154 of the Constitution, and asks that the Provincial Executive take that into account when considering any intervention in terms of section 139(1) of the Constitution.”
