Parliament to oppose Lekota's court action

Presiding officers believe deputy speaker acted within her constitutional powers

Presiding Officers of the National Assembly to defend court action instituted by COPE and Its Leader Mr Mosiuoa Lekota

3 Aug 2012

The Presiding Officers of the National Assembly will defend the court action brought by the Congress of the People (COPE) and its leader Mr Mosiuoa Lekota against both the Speaker and the Deputy Speaker.

On Tuesday, 31 July 2012 the Speaker and the Deputy Speaker of the National Assembly were served with a High Court application by COPE and its leader Mr Lekota. In their application, the Applicants seek an order, amongst others, declaring the ruling handed down by the Deputy Speaker on 12 June 2012 to be unlawful and inconsistent with the Constitution. They further seek an order reviewing and setting aside the said ruling.

The Speaker and the Deputy Speaker will oppose the application on the basis that, in making her ruling, the Deputy Speaker acted within her Constitutional powers.
