Party wants to know how DPP concluded there was no reasonable prospect of a successful prosecution

Phala Phala: BOSA requests NPA’s record of decision to not prosecute anyone involved

Build One South Africa (BOSA) notes with surprise the National Prosecuting Authority’s decision to decline prosecution of anyone involved with the now infamous Phala Phala saga, in which approximately $4 million of undeclared foreign currency was allegedly stolen from President Cyril Ramaphosa’s private game farm.

The NPA said in a statement that “The decision not to prosecute was taken by the DPP after a careful assessment of all available evidence presented to the prosecutors by the DPCI. She concluded that there was no reasonable prospect of a successful prosecution based on evidence contained in the docket.”

We are of the view that such a bold decision requires absolute transparency. As such, BOSA will today write to the National Director of Public Prosecutions (NDPP), Adv Shamila Batohi, requesting the full record of decision in this matter. The rationale behind this decision requires public ventilation so as to satisfy citizens that it was taken in good faith and sound judgment was applied.

BOSA has a zero tolerance policy towards corruption and wrongdoing by those in public office. We will continue to push for greater urgency in apprehending and charging those who abuse their position for personal gain.
