Phala Phala: We knew Ramaphosa's approach to ConCourt was irrational – EFF

Fighters says it is time for parliament to set its investigation into motion

EFF statement on the Constitutional Court ruling against Mr Cyril Ramaphosa on the Phala Phala report

1 March 2023

The Economic Freedom Fighters (EFF) welcomes the Constitutional Court's ruling against Mr. Cyril Ramaphosa on his direct application to the Constitutional Court, to reverse the findings and recommendations of an independent Parliamentary Inquiry, into allegations of wrongdoing in Phala Phala Farm.

From the beginning, we as the EFF knew that Mr. Ramaphosa's approach to the Constitutional Court was irrational and senseless, because he was asking the highest Court in the land to prevent Parliament from holding him accountable on the many crimes committed in Phala Phala.

Parliament has an obligation to find out and reveal to the people of South Africa as to the origins of the millions of dollars found in Ramaphosa's Farm, and also expose the nefarious roles played by members of the South African Police Services, and the inaction of other important State institutions.

These institutions include the South African Revenue Services (SARS), South African Reserve Bank (SARB), Financial Intelligence Centre (FIC), and all other institutions and entities that are obliged to act against all forms and manifestations of financial crimes.

Today, the Constitutional Court has correctly and decidedly rejected Mr. Ramaphosa's attempts to prevent Parliament from holding him accountable, and we demand that the Speaker of Parliament must as a matter of urgency put in place mechanisms, committees and and set aside resources for Parliament to investigate all the crimes committed in Phala Phala.

Parliament must gain access to Phala Phala Farm, subpoena Mr. Ramaphosa, interview all the workers including his Protectors and Advisor, gain footage to all of what transpired and call all State institutions that did not do anything about Phala Phala. We carry the obligation as public representatives to protect South Africa's laws particularly when they are threatened by powerful politicians in the State.

We have therefore written to the Speaker of Parliament to demand the establishment of an ad hoc Committee to investigate all crimes committed in Phala Phala and to formally establish the impeachment process against Mr. Cyril Ramaphosa. It will be irrational, senseless and reckless for the Speaker to refuse to hold Mr. Ramaphosa accountable.

We as the EFF demand that Mrs Nosiviwe Mapisa Nqakula must save herself from humiliation, and from being held personally liable for the Court action we are going to pursue and win if she refuses to set up accountability mechanisms against Mr. Ramaphosa on the Phala Phala crimes.

We will closely monitor all developments and will not close any eye to what has to happen.

The dismissal of Ramaphosa by the Constitutional Court must be a call to action to all people of South Africa to join the National Shutdown on the 20th of March 2023, and demand his immediate resignation.

Ramaphosa has undermined the economy of South Africa by smuggling money into this country, not paying tax, and violating the Constitution.

Ramaphosa Must Resign Now!
