ActionSA seeks Public Protector’s intervention in illegal Nigerian immigrant implicated in illegal hijacking of property in Ekurhuleni

This morning ActionSA wrote to the Acting Public Protector, Advocate Koleka Gcaleka regarding the release on bail of Tony Khadzadi, an illegal immigrant allegedly involved in the illegal hijacking of property in Ekurhuleni.

On 23 January 2023, an illegal immigrant named Tony Kadzadi who is of Nigerian nationality, was released on bail despite not having the proper documentation to reside within the borders of the Republic of South Africa.

What further exacerbates the situation is his general approach to life in South Africa – where he routinely commits crimes – seemingly with impunity.

Current case numbers against Kadzadi include:

Primrose CAS 87/01/2023: Relating to his illegal immigrant status in South Africa

Primrose CAS 96/01/2023: Relating to sexual harassment.

Primrose CAS 273/12/2022: Relating to theft of property.

Further to the cases above, Mr Kadzadi has been unlawfully hijacking properties in Ekurhuleni since at least 2021. A complainant by the name of Mr Godfrey Mncedane has come to me as well as the legal firm representing the owner of a further 2 properties, with evidence that Kadzadi hijacked the property in which he resided and worked.

To that end, ActionSA requested Adv. Gcaleka’s urgent intervention as to how Mr Kadzadi was able to obtain bail despite his illegal immigrant status. It is of concern to all law-abiding South Africans citizens that this individual from Nigeria was able to enter our country, remains completely at ease to reside in our country’s borders without the proper documentation and further commits crimes against South African citizens.

Furthermore, we have written to the Minister of Home Affairs, IPID and the Director of National Director of Public Prosecutions in this matter. We have also visited the Office of the Gauteng Provincial Police Commissioner regarding this absurd state of affairs.

Despite this, they have taken no action and Mr Khadzadi remains in South Africa illegally to continue to do as he pleases. We have asked the Public Protector to assist shed light on how the National Prosecuting Authority, the National Department of Home Affairs and the South African Police Service allowed this to happen and most importantly how and by when, your office will remedy the situation.
