This serves to inform you that your application for a mining right has been refused in terms of section 23(3) of the Act, based on the following reasons.
1. your application was submitted prematurely and in an irregular, misleading and fraudulent manner, in breach of section 98(b) of the Act; and
2. you failed to comply with sections 39(1) and (3) of the Act, and with regulations 48, 49, 50 and 51 of the Mineral and Petroleum Resources Development Regulations, in that you failed to compile scoping and environmental impact assessment reports as contemplated in regulations 49 and 50 and you also failed to submit an Environmental Management Programme as contemplated in regulation 51.
3. You are in contravention of section 38(1)(a),(b),(c) and (d) of the Act as ascertained during a compliance inspection conducted in respect of the mining activities of the Sishen Iron Ore Mine.
4. Your application does not meet the requirement stated in section 23(1)(h) of the Act in that the granting of the right applied for will result in the concentration of the mineral resource, iron ore, under your control which, in turn, will frustrate the furtherance of the objects referred to in section 2(d); alternatively will fail to further such objectives.

Your application does not meet the requirement stated in section 23(1)(h) of the Act on basis additional to and in conjunction with that referred to in paragraph 4 above, in that the granting of the right will not further the object referred to in section 2(f) of the Act. In terms of the provisions of 23(2) read with Section 26, I have, in this regard, also taken into consideration the nature of the mineral in question and the importance thereof to the local steel industry and to the economy as a whole.
