ANC warns ANCYL NEC against defying constitution of ANC

Party leadership will be responding to League's decision to reject Malema suspension

ANC STATEMENT ON THE DECISION OF THE ANCYL NEC

The African National Congress has noted the decision taken by the  National Executive Committee of the ANCYL, during its  meeting held in Johannesburg today, to ignore the decision of the National Disciplinary Committee which suspends Comrade Julius Malema temporarily. 

The leadership of the ANC will look at these developments and respond appropriately. On the issue of requesting a meeting between the NEC of the ANC and that of the ANCYL, this matter will be duly handled by the leadership of the ANC.  This will however not interfere with the pending disciplinary process of the ANC members who are also ANCYL members.

The decision to defy the ruling of the NDC is tantamount to defying the Constitution of the ANC.  The decision of the NDC to temporarily suspend Comrade Julius Malema is an injunction deriving from the Constitution of the ANC.  As the ANC we believe that he Constitution of the ANC is the ultimate authority on matters of the organization and thus sacrosanct to all its members and structures including the ANCYL NEC.  Instead of defying the Constitution of the ANC Comrade Julius Malema has an opportunity provided by the same Constitution to appeal to the NDCA for a review of the suspension decision.

All structures of the ANC are guided, including the ANCYL, by  the Constitution of the ANC. All structures of the ANC are equally expected to respect  and abide by decisions taken by the structures created by our Constitution, these structures include the NDC. The ANCYL must guard against decisions and pronouncement that undermine the Constitution of the ANC.

On the accusation that there has been no communication of the decision by the NDC, we would like to restate that the decision was communicated to the relevant parties concerned including Comrade Julius Malema himself, the Secretary General of the ANC as well as the South African Public as prescribed in our Constitution.

We would like to advise the ANCYL NEC that regrettably their decision to undermine and defy the decision of the NDC effectively defines the organisation outside of the ANC Constitutional parameters, and therefore that is totally unANC.  We will persuade the ANCYL NEC not to continue with their intention to undermine and defy the Constitution of the ANC.
